Terms of Service

1. Who We Are

GainGuard Capital ("GainGuard", "we", "us", or "our") operates a managed-investment platform through which clients can invest in foreign exchange, precious metals, digital assets, and related opportunities, with the assistance of dedicated account managers and fund managers.

These Terms form a binding agreement between you ("you", "your", or "the client") and GainGuard Capital.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Services. You must complete our identity-verification (KYC) process before you can invest.

You are responsible for ensuring that your use of the Services is lawful in the jurisdiction in which you reside. The Services may not be available, or may be restricted, in certain jurisdictions.

3. Membership and Fees

Access to trading and investing on the platform requires a one-time platform membership fee of USD 1,000. The minimum initial investment is USD 1,000, which is separate from and in addition to the membership fee.

Investing above USD 1,000,000 is reserved for members of the Elite Club, which is available by invitation and carries a separate membership of USD 5,000.

All fees are payable in the cryptocurrencies we accept and are non-refundable except where required by law or expressly stated by us in writing.

4. Investments, Tiers, and Managers

Once your identity is verified and your membership is active, you may allocate funds into the investment tiers made available on the platform. Your funds are managed by our fund managers, and your dedicated account manager serves as your point of contact.

Return figures, performance targets, and tier descriptions are indicative only. They are objectives, not promises, and do not constitute a guarantee of any particular result. Actual performance will vary and may be negative.

5. Deposits and Payments

Membership and investment amounts are funded by transferring cryptocurrency to the deposit addresses we provide at the time of payment. You are solely responsible for sending the correct amount, in the correct asset, on the correct network, to the correct address.

Cryptocurrency transactions are irreversible. We cannot recover funds sent to an incorrect address, on the wrong network, or in the wrong asset. A payment is only credited after it has been verified and confirmed by our team.

6. Returns and Withdrawals

Any returns credited to your account are recorded by our managers and reflected in your dashboard. Returns are not fixed, not guaranteed, and may be positive or negative in any given period.

Withdrawal requests are subject to verification, applicable holding periods, anti-money-laundering checks, and the availability of funds. We may decline or delay a withdrawal where required by law or where fraud or misuse is suspected.

7. Risk Acknowledgment

Investments can rise substantially in value or fall in value, up to and including the total loss of the amount you invest. By investing through GainGuard Capital, you acknowledge and accept responsibility for both possibilities — the possibility of gains and the possibility of loss — and you agree that you invest entirely at your own risk.

You confirm that you are investing money you can afford to lose, that you have considered your own financial circumstances, and that you are not relying on GainGuard for personalized financial, legal, or tax advice. Please also read our Risk Disclaimer, which forms part of these Terms.

8. Your Responsibilities

• Provide accurate, current, and complete information during registration and verification.
• Keep your login credentials secure and notify us immediately of any unauthorized access.
• Use the Services only for lawful purposes and not to launder money or finance illegal activity.
• Ensure you control the wallet from which you send funds.

9. Suspension and Termination

We may suspend or terminate your account if you breach these Terms, fail verification, or if we are required to do so by law or to prevent fraud or misuse. Where your account is suspended, your access to the Services may be restricted pending resolution.

10. Limitation of Liability

To the fullest extent permitted by law, GainGuard is not liable for investment losses, loss of profits, or any indirect or consequential loss arising from your use of the Services or from market movements. Nothing in these Terms excludes liability that cannot be excluded by law.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the platform or by email. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law and Contact

These Terms are governed by the laws of the jurisdiction in which GainGuard Capital is incorporated, without regard to conflict-of-law principles. Any disputes will be handled in accordance with that jurisdiction.
